These terms
These terms of carriage govern every consignment Khalz Swift Lyft Logistics and Hardware Industry LLC accepts, and every payment taken for it. They apply whether a booking is made by email, by telephone, through our offices or through a payment link we issue.
Placing a booking, handing over goods, or paying an invoice means you accept these terms. Where we have signed a separate written contract with you, that contract takes priority over anything inconsistent here.
We may revise these terms. The version in force for a consignment is the one published on the date the booking was accepted, and the effective date above tells you which that is.
Words we use
- Consignment — goods accepted from one shipper, at one time, at one address, for carriage to one consignee at one destination.
- Shipper — the person or company who hands goods to us, and who is responsible for charges unless we have agreed otherwise in writing.
- Consignee — the person or company named to receive the consignment.
- Waybill — the consignment record we issue, including its tracking number. It is evidence of the contract of carriage; it is not a document of title and it is not negotiable.
- Charges — freight, surcharges, duties, taxes, storage, re-delivery, demurrage and any cost we properly incur in carrying out the booking.
Bookings and quotations
A quotation is an estimate based on the weight, dimensions, commodity and route you give us. It is valid for 7 days and is not a booking. We may re-rate a consignment if the goods we receive differ from the goods described — including on re-weigh or re-measure, where volumetric weight applies.
A booking is accepted only when we confirm it and issue a tracking number. We may decline or return any consignment, before or after collection, where it is unsafe, unlawful, inadequately packed, or outside the service we quoted.
You are responsible for the accuracy of everything you declare: the commodity, its value, its weight, the addresses, and any hazard classification. We rely on your declaration and we do not open or inspect goods as a matter of course.
Goods we will not carry
We do not accept the following, and we are not liable for loss, damage or delay to anything in this list if it is tendered to us without our prior written agreement:
- Currency, bearer instruments, bullion, precious stones and loose precious metals.
- Firearms, ammunition, explosives, fireworks and weapon parts.
- Narcotics and controlled substances, and goods whose import or export is prohibited at origin, transit or destination.
- Counterfeit goods, and goods infringing a trade mark, copyright or patent.
- Live animals, human remains and body parts, and biological samples outside an agreed cold-chain service.
- Dangerous goods under the applicable IATA, IMDG or ADR rules, unless declared in advance, correctly classified, packed, marked and documented, and accepted by us in writing.
- Perishable goods and temperature-sensitive pharmaceuticals, unless booked on a service that provides for them.
If a prohibited item is found in a consignment we may hold it, return it, surrender it to an authority, or dispose of it where the law requires — and you remain responsible for the charges and for any penalty, fine or cost we incur.
Packing, marking and documents
You must pack each consignment to withstand ordinary handling, stacking, vibration and transfer between vehicles, aircraft and vessels, and to protect anything travelling alongside it. Each piece must carry a legible address label and the tracking number we issue.
You must give us complete and accurate documents for the route: commercial invoice, packing list, licences, certificates of origin, and any dangerous-goods declaration. Where documents are missing or wrong, we may hold the consignment, and storage and re-delivery charges apply.
Customs, duties and taxes
We act as your agent for customs purposes. Duties, import taxes, inspection fees, deposits and clearance charges are payable by the shipper or consignee as the terms of sale provide, and we may require payment or security before we release goods or advance funds on your behalf.
Where an authority inspects, detains, seizes or destroys a consignment, we will tell you as soon as we are able. Charges remain payable, and we are not liable for the authority's decision or for any delay it causes.
Transit times and delivery
Transit times we publish or quote are estimates in working days, not guarantees, and they exclude time spent in customs, time waiting for documents, and time lost to events outside our control. Where we have sold a timed or guaranteed service in writing, that commitment is the one that binds us.
We deliver to the address on the waybill, not to a named individual, and a signature at that address — including a neighbour, reception, mailroom or security desk — completes delivery. Where you have agreed a safe place or a release instruction with us, following it completes delivery.
If delivery fails we will attempt it again or hold the consignment for collection. After 5 working days in store, storage charges begin; after 30 days we may return the consignment at your cost or, where it is perishable or unsafe, dispose of it.
Charges and how payment works
Charges are payable before carriage unless you hold a credit account with us, in which case our agreed terms apply. We issue a payment link for each account; paying through it settles the invoice it names, and we email a receipt carrying a payment reference. Quote that reference in any query and we can find the payment and the consignment it belongs to.
We accept card and cryptocurrency. Card payments are processed by our payment partner on its own hosted page, which may include a one-time identity check on a first payment; card numbers are never entered on, held by or transmitted through our systems. Cryptocurrency payments are settled onchain and are irreversible once confirmed — send only the asset and network shown on the payment page, as anything else cannot be recovered.
Where a payment arrives short of the invoiced amount — network fees are deducted from the amount sent, so crypto payments routinely land slightly light — we credit what actually arrived and the balance remains due. Overpayments are refunded to source or held against the account at your election.
Charges quoted exclude VAT and other applicable taxes unless stated. Sums unpaid after their due date carry interest, and we may suspend services and withhold consignments while an account is overdue.

Our liability, and its limits
Where an international convention applies to a carriage — the Montreal Convention by air, the Hague-Visby Rules by sea, CMR by road — our liability is governed and limited by that convention, and nothing in these terms reduces a right it gives you.
Where no convention applies, our liability for loss of or damage to a consignment is limited to its repair or replacement value. We are not liable for loss of profit, loss of market, loss of contract, business interruption, or any other indirect or consequential loss, however arising.
We are not liable for loss or damage caused by your packing, your description of the goods, an inherent defect in the goods, the act of a public authority, or your breach of these terms. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Cargo insurance
Carriage is not insurance. The limits above apply by default and will usually be well below the commercial value of a consignment. We can arrange cargo insurance on request, at your cost, if you tell us the value before collection — ask us for a quotation and we will confirm the cover in writing before the consignment moves.
Claims
Tell us in writing as soon as you can, and in any event within 7 days of delivery for visible damage or shortage, and within 21 days of the expected delivery date for loss or non-delivery. Keep the goods and the packaging available for inspection.
Submit the full claim, with the waybill number, photographs, a commercial invoice showing value, and evidence of the loss, within 30 days of that first notice. We may decline a claim notified outside these periods, and a claim is not valid while charges on the consignment remain unpaid.

Lien and right of sale
We have a general lien on goods and documents in our possession for all sums you owe us, whether in respect of that consignment or another. Where sums remain unpaid 30 days after we have given written notice, we may sell the goods and apply the proceeds against the debt and the costs of sale, accounting to you for any balance.
Events outside our control
We are not liable for failure or delay caused by something beyond our reasonable control — weather, natural disaster, war, civil unrest, strike or industrial action, port or airport congestion or closure, carrier or network failure, epidemic, cyber attack, or the act of a public authority. Where such an event continues, we will consult you on storage, return or an alternative route, and the resulting charges are payable.
Personal data
We handle personal data as set out in our privacy notice. Carriage necessarily involves disclosing consignment and contact details to carriers, agents and customs authorities at origin, transit and destination.
Governing law and disputes
These terms are governed by the law of the place where we are established, and its courts have exclusive jurisdiction, subject to any mandatory rule of an applicable convention. Talk to us first: most disputes end at [email protected].
